Terms of Service
Family Photography
1. Ownership of Photographs
All photographs taken during the session remain the copyright and intellectual property of the Photographer.
Clients receive personal-use rights, but copyright is not transferred.
2. Personal Use License
Upon full payment, the Client receives a non-exclusive, perpetual license to use the final delivered photographs for personal purposes, including:
- printing and framing
- sharing with family and friends
- posting on personal social media (credit @fotoreflection, @moussa faddoul)
3. Restrictions
The Client may not:
- use photographs for commercial purposes (ads, promotions, business websites)
- sell or resell the images
- provide images to third parties for business use
- heavily alter or filter images in ways that misrepresent the Photographer’s style
- request RAW or unedited files (these are not provided; available to purchase)
4. Editing & Delivery
The Photographer delivers professionally edited high-resolution images.
Final images are delivered within 10 business days via a private online gallery or download link.
5. Payment & Session Fee
- A non-refundable session fee is required in full to secure the session date.
6. Rescheduling & Cancellations
Life happens — especially with kids.
- Rescheduling is allowed with at least 48 hours’ notice, subject to availability.
- Payments are non-refundable, but may be transferred to a new date if notice is given.
Weather reschedules for outdoor sessions will be decided by the Photographer.
7. Liability & Safety
The Photographer is not responsible for:
- accidents, injuries, or incidents that occur during the session
- cooperation of children or pets (but we always try our best!)
- delays caused by the Client arriving late
In the event of unexpected equipment failure or other issues beyond the Photographer’s control, liability is limited to a reshoot.
- Model Release
The Photographer may use images for their website, social media, and portfolio to showcase their work.
Clients may opt out at any time by informing the Photographer in writing before image delivery.
9. Client Agreement
By booking a session and receiving the final images, the Client acknowledges and agrees to these Terms of Service.
Commercial Photography
These Terms of Service (“Terms”) govern the provision of commercial photography services by Fotoreflection (“Photographer,” “we,” “us”) to the client (“Client,” “you”). By booking, signing an agreement, or making payment, you agree to these Terms.
1. Booking & Payment
Full payment is required at the time of booking to secure the agreed date and time. All payments are non-refundable, unless otherwise agreed to in writing. Booking confirmation constitutes acceptance of these Terms.
2. Rescheduling & Cancellations
Rescheduling is permitted with reasonable notice and subject to availability. All rescheduled dates must be confirmed by Fotoreflection. Cancellations do not qualify for a refund. Fotoreflection reserves the right to reschedule due to circumstances beyond reasonable control (including illness, equipment failure, weather, or force majeure), in which case a mutually agreed replacement date will be arranged.
3. Scope of Work
The scope of work, including services, deliverables, timelines, fees, and usage rights, will be outlined in the written agreement, proposal, or invoice. Any changes or additional services requested after booking may result in additional fees and revised delivery timelines.
4. Copyright & Usage Rights
All photographs remain the exclusive property and copyright of Fotoreflection under the Copyright Act (Canada). Usage rights granted to the Client are limited to those expressly stated in the agreement or invoice. Images may not be altered, sublicensed, sold, transferred, or used beyond the agreed purpose without prior written consent from Fotoreflection.
5. Model Release & Permissions
The Client is responsible for informing all participants, employees, or event guests that photography will take place and for obtaining any required permissions or model releases. Unless otherwise agreed in writing prior to the session, Fotoreflection may use selected images for portfolio, marketing, promotional, editorial, and self-promotional purposes.
6. Client Responsibilities
The Client agrees to provide accurate information, ensure access to locations, obtain necessary permits, and secure permissions required for photography. Fotoreflection is not responsible for compromised coverage or missed content due to restrictions, delays, or conditions outside its control.
7. Image Delivery & Archiving
Final images will be delivered digitally within the timeframe specified in the agreement. Fotoreflection is not obligated to retain or archive images beyond a reasonable period following delivery. Clients are responsible for downloading and backing up all delivered files.
8. Limitation of Liability
Fotoreflection will take reasonable care in providing services but shall not be liable for indirect, incidental, or consequential damages. Any liability shall be limited to the total fees paid by the Client for the services rendered.
9. Indemnification
The Client agrees to indemnify and hold harmless Fotoreflection from any claims, damages, liabilities, or expenses arising from the Client’s failure to obtain required permissions, releases, licenses, or authorizations.
10. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
11. Acceptance
By booking services, signing an agreement, or submitting payment, the Client confirms they have read, understood, and agreed to these Terms of Service.
